Terms and Conditions for Business Use of goodiepack.com

Before using the Platform, please carefully review these terms (“Terms”). By using the Platform or other services offered by the Company, you agree to these Terms. If you object to any part of these Terms, you should not use the Platform.

These Terms apply between you as a customer and GoodiePack ApS (CVR No. 37197572) (the “Company”) when you use www.goodiepack.com and all other tools, websites, or services related to GoodiePack ApS.

By using the Platform, you also agree to the Data Processing Agreement, which can be found here.
The Company reserves the right to modify, add to, or remove parts of these Terms at any time. It is your responsibility to check the Terms before using the Platform.

Continued use of the Platform after any changes signifies your acceptance of the updated Terms.
As long as you comply with these Terms, the Company grants you a personal, non-exclusive, non-transferable, limited right to use the Platform solely in accordance with these Terms.

About the Platform and Its Usage

The Platform is an online service that allows you to create and offer digital goods (“goodies”) collected in a (“GoodiePack”). A GoodiePack consists of one or more goodies.

The Platform enables you to easily create a profile (“Profile”) and set up your unique GoodiePacks. These GoodiePacks can then be shared with your guests, readers, audience, etc. (“Users”) as desired.

Users can “download” or claim a GoodiePack via the Platform.

Creating a Profile

When creating a Profile on the Platform, you must provide basic information, such as name, company, address, email, phone number, etc. (“Information”). This Information can always be updated or modified.

You acknowledge that others you send a GoodiePack to may see some of this Information.

You warrant that the Information you provide is accurate and does not infringe on the rights of others.

By creating a Profile and/or logging into the Platform, you confirm that you have full authority to use the information you provide and that you are an adult over the age of 18.

Creating a GoodiePack

When creating a GoodiePack, you must enter various details (such as URL, date, and title) and upload images and text for its content (collectively, “Material”).

You warrant that the Material you upload is accurate, does not infringe on the rights of others, and that the content of your GoodiePack complies with your agreements with partners/sponsors. If a User successfully claims compensation from the Company for a goodie or similar, you agree to indemnify the Company.

The Company cannot guarantee the content of a GoodiePack.

Payment

Payment is made according to the agreement you have with GoodiePack ApS, either by invoice or credit card.

You must provide your payment details (“Payment Information”) when selecting an activation date for your GoodiePack. Payment is processed upon activation of the GoodiePack.

Payments are handled via the payment service Stripe (www.stripe.com). Stripe is PCI compliant, and your Payment Information will be transmitted to and processed through Stripe in encrypted form (SSL). Stripe is responsible for your Payment Information, and the Company will never store or retain such details.

The Company reserves the right to offer different access levels to the Platform, including various features or services. The Company also reserves the right to change pricing for these levels but only for future user access and never retroactively.

Data Storage

All your data (including Information and Material) is stored by the Company for an indefinite period as long as your Profile remains active, in accordance with GDPR regulations.

If you delete or cancel your Profile, or if your Profile is terminated by the Company in accordance with these Terms, your data may be deleted or made inaccessible.

The Company takes active measures to protect your data and prevent unauthorized access to your Information and Material. The Company has appointed a Data Protection Officer ("DPO") to ensure compliance with GDPR and internal data protection policies. You can contact the DPO at dpo@goodiepack.com. However, the Company is not liable for unauthorized access by third parties and provides no guarantee against such breaches.

Cookies

By using the Platform, you consent to the Company’s use of cookies and widgets for various purposes. GoodiePack ApS collects necessary cookies, preference cookies, operational and optimization cookies, and cookies for targeted advertising.

Disclaimer of Liability

The services provided via the Platform are general in nature and intended to assist, not replace, professional services.

The Company disclaims all liability for the usage or success of GoodiePacks created on the Platform.

You are solely responsible for managing sponsors or partners who may wish to withdraw their participation in your GoodiePack, as well as Users who may wish to cancel their claim under applicable consumer protection laws.
